These are marital assets subject to equitable distribution. It does not matter that the working spouse earned them, or that the accounts are only in one spouse’s name. Be aware, however, that a valuation of assets can get tricky if these assets were acquired before the marriage and carried over afterward.
I invested so much into my beautiful house. How can it be divided?
Division of the marital residence is a scary prospect, particularly if you are living in the house and cannot afford a buyout. While the marital residence is typically subject to an equal split, be assured that a sale/buyout is not the only way to divide this asset. A creative attorney can explore offsets with other assets or income. Other options may be to advocate for a larger portion of this asset or a deferment of the sale.
I’ve always been the one to support our family. Will I need to pay spousal support? How is support calculated altogether?
The primary consideration for an award of spousal support, a/k/a alimony, is the existence of economic reliance by one spouse upon another. If you have historically been the breadwinner in a long term marriage, you will likely have to pay spousal support. There are multiple considerations involved in the amount and length of an alimony award, which a creative attorney can use to your advantage.
